1. Accepting these terms

These Terms govern your access to and use of Learning With Momo, including the website at learningwithmomo.com, the app, the Reading tutor, the Learning With Momo app for Android, and any related features (the "Service"). By creating an account or using the Service, you agree to them and to our Privacy Policy. If you do not agree, please do not use the Service.

Nothing here limits any right you have under Ontario or Canadian consumer protection law that cannot lawfully be waived.

2. Who may use it, and children

The Service is designed for learners of all ages, including young children. However, the account holder must be an adult: someone who has reached the age of majority where they live and can enter into a binding contract. If a learner is a child, a parent or legal guardian must create the account, agree to these Terms and the Privacy Policy, and supervise the child's use. Children do not get their own accounts.

When you add a learner to a family list, or a reader to the Reading tutor, you confirm that you are that learner's parent or legal guardian, or have their parent's or guardian's permission (or, for an adult learner, their own permission), and you agree on the learner's behalf to the collection and use of their information described in the Privacy Policy.

You are responsible for activity under your account, for keeping your password and sign-in codes confidential, and for telling us promptly if you think someone else has access to the account.

3. The Service

We grant you a limited, personal, non-exclusive, non-transferable right to use Learning With Momo for your own household's learning. You may not resell it, share your sign-in details outside your household, use it to build a competing product, copy or extract the audio library or word lists, or attempt to bypass access controls.

The Service is offered for personal, family and educational use. For classroom, school or organizational use, contact us first.

4. Trials, memberships and payments

New accounts currently receive a 90-day trial at no cost, and no card is needed. Some accounts receive a longer complimentary membership at our discretion. We may change trial and membership lengths for future accounts.

We do not take payments. We do not currently charge for the Service, and we do not collect payment information. Nothing can be bought in the Service, including in the Android app, which does not show prices.

When a trial or membership ends, access to the app stops until a membership is in place. Whether to extend a trial or grant a membership is up to us, and doing so once does not oblige us to do it again. Your information is kept or deleted as the Privacy Policy describes.

Nothing we publish about plans or prices is an offer. Plans that are not available yet cannot be bought, and they may change or never be offered. If we ever start charging, we will show you the price and the terms before you pay anything, and you will have to agree to them first. We will not turn a trial or a complimentary membership into a paid one without your express agreement.

5. Your account, your information, and deleting it

You keep any rights you have in what you enter, such as learners' names or nicknames, Reading nicknames and feedback messages. You allow us to store and use them only to run and improve the Service, as the Privacy Policy describes. Please use a first name or nickname for each learner, not a full name.

You can delete your account, and the data we store with it, at any time: tap "Delete my account" on the app's "My progress" screen, use the "Delete account" link at the bottom of the app, or go to learningwithmomo.com/delete-account. The Privacy Policy lists what is deleted and the little that remains for a while. Deleting an account cannot be undone.

We do not currently delete unused accounts. If that changes, we will update the Privacy Policy first and email the accounts affected before anything is deleted.

6. Acceptable use

We may suspend or terminate an account that breaches these Terms.

7. Educational content, and what it is not

Learning With Momo teaches everyday words and short phrases in several languages, including Lebanese Arabic and Standard Arabic, plus the Arabic alphabet and, in the Reading tutor, early English reading (phonics). Language is regional and living: pronunciations, spellings and word choices vary by country, region, household and generation. We aim for accuracy and correct what we get wrong, but we do not warrant that every word, dialect form or pronunciation is correct or suitable for a particular region or purpose.

The audio is pre-made computer speech (AI voices), with a few clips made from our own recordings. Some words, such as Arabic letter names, are spoken by your device's built-in voice, which we do not control. The speaking features let you record yourself and listen back on your device. They do not recognize speech or judge pronunciation.

The Service is a learning aid. It is not a translator, and it is not a substitute for formal instruction, certification, translation services, or professional advice of any kind.

8. Our content and your feedback

All content in the Service, including the audio, word lists, curriculum, artwork, characters and software, belongs to us or our licensors and is protected by copyright and other laws. These Terms do not transfer any ownership to you.

If you send us feedback or suggestions, you agree we may use them to improve the Service without obligation or compensation to you. Please do not send us anything confidential.

9. The Android app

The Learning With Momo app for Android, once it is published on Google Play, opens the same Service in your phone's browser, usually Google Chrome. These Terms and the Privacy Policy apply to it in the same way. Google Play's own terms apply to downloading and updating the app. Google is not a party to these Terms and is not responsible for the Service.

10. Availability, changes and offline use

We may add, change, or remove features, and we may suspend the Service for maintenance or stop offering it. We try to give notice of significant changes but cannot always do so.

The app can be installed on a device, and in some age modes a language can be saved for offline use. Offline use currently works for up to 7 days after the app last confirmed your trial or membership online. Offline access depends on your device and is provided as a convenience. We do not guarantee that it will always be available, and the app will ask you to reconnect to confirm your trial or membership.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or free of harmful components.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, punitive or exemplary damages, or for lost data, lost profits, or loss of goodwill, arising out of or relating to the Service.

Our total aggregate liability arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred Canadian dollars (CAD $100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, or for death or personal injury caused by negligence.

13. Indemnity

To the extent the law allows, you agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising from your breach of these Terms or your misuse of the Service, except to the extent caused by our own breach.

14. Termination

You may stop using the Service and delete your account at any time (section 5). We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination, including sections 8, 11, 12, 13 and 15, will survive.

15. Governing law and disputes

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict of laws rules. The courts of Ontario have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory laws of your place of residence.

16. Changes to these terms

We may update these Terms. We will change the effective date above. If a change matters, the app will show you the updated Terms and ask you to agree before you carry on, and we may also email account holders.
